Sharing the Portfolio Manager facility profile

LEED EBOM v2009 allows you to skip the SEP submittal if you share your Portfolio Manager facility directly with the USGBC review team.

This is a 5000sq ft office building to be built in an existing building. When they dig the columns foundations they discovered two fuel oil 2 tanks.

If all the plumbing fixtures are to be installed in future by tenant, and if I check Tenant Neutral for WE p1; I will not be able to achieve the prereq. 20%. Is this typical?
