NC-2009 SSc8:Light Pollution Reduction

Uplights under cover / underwater

Hello All, Are exterior uplights exempt from the 90 degrees above nadir categorisation if they are under cover of a shading structure, such as a canvas sail or cabana? If so what proof would be required? Also can you confirm that there is no difference to swimming pool lighting requirements. Thanks, Francis
